Frequently
Asked Questions: Nursing Home Abuse
What do I do if I suspect
abuse or neglect?
If you suspect abuse, exploration or neglect of an
elderly person, you are required by Texas law to report
the abuse to the proper authorities. You can contact
the Texas Department of Human Services (long-term
care) at 1-800-458-9858. If you suspect that someone
is in imminent danger due to the abuse or neglect,
the department of Human Services is required to investigate
the complaint within 24 hours. The nursing home will
not be given advanced warning.
Will the abuse or neglect
stop if I take legal action?
Nursing home abuse
and neglect often stems from systemic problems: poor
management practices, inadequate training, or poor
hiring practices. Sometimes, it takes a lawsuit to
get management's attention - and sometimes the nursing
home won't take corrective action until a jury sends
a message through a verdict. The important thing to
remember is that abuse will not stop on its own. Do
not ignore your suspicions. If you suspect that a
loved one is being abused or neglected, call McLarty * Roper * Pope, L.L.P. for a free consultation.
